Although the Chinese government&nbsp;<a href=\"https:\/\/archive.ph\/AIsxQ\">claims<\/a>&nbsp;it appoints law enforcement officials overseas in order to more conveniently handle mundane matters like Chinese driver\u2019s license renewal and international divorce cases, U.S. lawmakers and intelligence analysts say China\u2019s underground courts could easily be weaponized to punish dissidents and expand communist influence abroad.<\/p>\n\n\n\n<p>01:36<\/p>\n\n\n\n<p>03:36<\/p>\n\n\n\n<p>Read More<\/p>\n\n\n\n<figure class=\"wp-block-embed\"><div class=\"wp-block-embed__wrapper\">\nhttps:\/\/imasdk.googleapis.com\/js\/core\/bridge3.686.0_en.html#fid=goog_804542724\n<\/div><\/figure>\n\n\n\n<figure class=\"wp-block-embed\"><div class=\"wp-block-embed__wrapper\">\nhttps:\/\/imasdk.googleapis.com\/js\/core\/bridge3.686.0_en.html#fid=goog_804542725\n<\/div><\/figure>\n\n\n\n<figure class=\"wp-block-embed\"><div class=\"wp-block-embed__wrapper\">\nhttps:\/\/imasdk.googleapis.com\/js\/core\/bridge3.686.0_en.html#fid=goog_804542726\n<\/div><\/figure>\n\n\n\n<p>Liu Pengyu, a Chinese Embassy spokesperson, told the DCNF that \u201cChinese law enforcement agencies conduct foreign law enforcement cooperation strictly in accordance with international law, fully respect foreign laws and judicial sovereignty, and protect the legitimate rights and interests of criminal suspects in accordance with the law.\u201d<\/p>\n\n\n\n<p>However, the DCNF found that not only are all the identified nonprofits&nbsp;<a href=\"https:\/\/archive.ph\/PcajY\">led<\/a>&nbsp;by individuals&nbsp;<a href=\"https:\/\/archive.ph\/2gHFJ\">working<\/a>&nbsp;with a Chinese&nbsp;<a href=\"https:\/\/www.uscc.gov\/sites\/default\/files\/annual_reports\/2016%20Annual%20Report%20to%20Congress.pdf\">intelligence service<\/a>&nbsp;called the United Front Work Department (UFWD), but some of their leaders have also explicitly&nbsp;<a href=\"https:\/\/archive.ph\/t8BQn\">discussed<\/a>&nbsp;forced repatriation operations with Ministry of Public Security (MPS) officials in China. Furthermore, several of the individuals&nbsp;<a href=\"https:\/\/archive.ph\/SdOBk\">appointed<\/a>&nbsp;to operate overseas Chinese courts in the U.S. also belong to the nonprofit that ran a Chinese police station in New York, which the Department of Justice (DOJ)&nbsp;<a href=\"https:\/\/www.justice.gov\/d9\/2023-04\/police_station_-_23-mj-265_amended_complaint_signed.pdf\">found<\/a>&nbsp;sought to forcibly repatriate individuals back to China.<\/p>\n\n\n\n<p>\u201cThe Chinese government\u2019s attempt to impose its repressive legal system on U.S. soil through the CCP\u2019s United Front network is an unacceptable assault on U.S. sovereignty and the rule of law,\u201d Michigan Republican Rep. John Moolenaar told the DCNF.<\/p>\n\n\n\n<p>\u201cThese actions jeopardize the safety and freedoms of Chinese Americans and undermine the principles of justice that define our nation,\u201d said Moolenaar, chairman of the House Select Committee on the CCP. \u201cCongress and law enforcement must remain vigilant, hold those involved accountable, and impose costs on the CCP\u2019s illicit United Front activities within the United States.\u201d&nbsp;<strong><a href=\"https:\/\/dailycaller.com\/2024\/12\/19\/exclusive-us-govt-awarded-sensitive-research-grants-scientists-chinese-communist-party-talent-programs\/\">(RELATED: EXCLUSIVE: US Gov\u2019t Awarded Sensitive Research Grants To Scientists In Chinese Communist Party Talent Programs)<\/a><\/strong><\/p>\n\n\n\n<h4 class=\"wp-block-heading\">\u2018Foot Soldiers\u2019<\/h4>\n\n\n\n<p>Chinese law enforcement agencies tapped at least eight U.S. nonprofit leaders to serve as \u201coverseas mediators\u201d and \u201chearing officers\u201d for underground courts on American soil, according to Chinese state media and government reports.<\/p>\n\n\n\n<p>Overseas mediators and hearing officers&nbsp;<a href=\"https:\/\/archive.ph\/WnxR6\">remotely<\/a>&nbsp;notarize and serve legal documents,&nbsp;<a href=\"http:\/\/www.jmradio.com\/web\/jmnews\/20221212\/1670846768263.shtml\">provide<\/a>&nbsp;a physical space to host video calls for mediation and litigation and&nbsp;<a href=\"https:\/\/archive.ph\/WTP3o\">advocate<\/a>&nbsp;on behalf of overseas compatriots, Chinese government and state-run media reports show.<\/p>\n\n\n\n<p>A November 2022 UFWD announcement&nbsp;<a href=\"https:\/\/archive.ph\/abAXf\">showcased<\/a>&nbsp;the Xinhui District court in Jiangmen, Guangdong province and its \u201cOverseas Dispute Mediation Station.\u201d The announcement identified the chairman of the San Francisco, California-based World Youth Congress of Jiangmen as one of the court\u2019s \u201coverseas mediators\u201d and highlighted his role in settling an international divorce case through video call.<\/p>\n\n\n\n<p>The Xinhui branch of China\u2019s organ for legal supervision, the Supreme People\u2019s Procuratorate, likewise appointed the chairman of the San Francisco-based Kong Chow Benevolent Association as a \u201chearing officer\u201d connected to its \u201cOverseas Chinese Inspection Liaison Station\u201d in 2022,&nbsp;<a href=\"https:\/\/archive.ph\/WTP3o\">according<\/a>&nbsp;to the Chinese government.<\/p>\n\n\n\n<p>The DCNF has not been able to determine if these entities have adjudicated criminal cases. Under Chinese law, most dissident speech is a criminal matter.<\/p>\n\n\n\n<p>Zhejiang and Fujian provincial law enforcement have also established U.S. hubs.<\/p>\n\n\n\n<p>In July 2016, a court in Lucheng District, Wenzhou, Zhejiang appointed the Wenzhou Los Angeles Chamber of Commerce as its first California \u201cOverseas Liaison Mediation Station\u201d and named its chairman as an \u201coverseas mediator,\u201d Chinese state media&nbsp;<a href=\"https:\/\/archive.ph\/IOabC\">reported<\/a>. The court had previously appointed members of the New York-based Wenzhou Chamber of Commerce and Industry as mediators in 2014, Newsweek&nbsp;<a href=\"https:\/\/www.newsweek.com\/2022\/12\/23\/xi-jinping-ramps-chinas-surveillance-harassment-deep-america-1764281.html\">reported<\/a>.<\/p>\n\n\n\n<p>The Changle Procuratorate in Fuzhou, Fujian recently also demonstrated similar ambitions when it unveiled an \u201cOverseas Chinese Protection Observation Station\u201d in September 2023 and told the honorary chairman of the New York City-based Fukien Benevolent Association of America and others they were to perform overseas procuratorial work,&nbsp;<a href=\"https:\/\/archive.ph\/ge0WP\">according<\/a>&nbsp;to a social media post.<\/p>\n\n\n\n<p>Meanwhile, Changle District court social media posts from&nbsp;<a href=\"https:\/\/archive.ph\/SdOBk\">2020<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.douyin.com\/video\/7070017376409947432\">2022<\/a>&nbsp;reveal it appointed three members of New York\u2019s America Changle Association to serve as \u201coverseas mediators.\u201d America Changle Association leader Chen Jinping recently pleaded guilty to \u201cconspiring to act as an illegal agent\u201d of China connected to running an \u201cundeclared overseas police station\u201d in New York,&nbsp;<a href=\"https:\/\/www.justice.gov\/opa\/pr\/new-york-resident-pleads-guilty-operating-secret-police-station-chinese-government-lower\">according<\/a>&nbsp;to the DOJ.<\/p>\n\n\n\n<p>The World Youth Congress of Jiangmen, Kong Chow Benevolent Association, Wenzhou Los Angeles Chamber of Commerce, Fukien Benevolent Association of America and America Changle Association could not be reached for comment.<\/p>\n\n\n\n<p>\u201cOverseas mediators\u201d and \u201chearing officers\u201d pose a national security threat, Chinese intelligence experts told the DCNF.<\/p>\n\n\n\n<p>\u201cThere are risks to national security because these civic organizations are exclusively pro-CCP \u2018United Front\u2019-led groups that are under the supervision of Chinese consulates, who, in turn, ultimately answer to the CCP,\u201d Ina Mitchell, a Chinese intelligence expert, told the DCNF. \u201cI can see them being strong-armed into spying and other illegal activity on U.S. soil in a deal brokered by a mediator assigned by the state.\u201d<\/p>\n\n\n\n<p>Dr. Lawrence Sellin, a national security expert, told the DCNF that despite overseas mediation stations and overseas Chinese police stations claiming to only offer benign legal services, the CCP will use them for malign purposes.<\/p>\n\n\n\n<p>\u201cIn reality, they are means by which the CCP can monitor and, when needed, punish members of the Chinese diaspora if they deviate from the CCP agenda,\u201d Sellin said. \u201cThat degree of control allows the CCP to enlist Chinese community members, willingly or unwillingly, as foot soldiers in the conduct of influence and espionage operations in the United States, which represents a national security threat.\u201d<\/p>\n\n\n\n<p><img decoding=\"async\" src=\"https:\/\/cdn01.dailycaller.com\/wp-content\/uploads\/2025\/01\/Jiangmen-overseas-mediation-scaled-e1735857555883.jpg\" alt=\"\"><\/p>\n\n\n\n<p also identified two U.S. nonprofit leaders working for the MPS, according to Chinese government records.<\/p>\n\n\n\n<p>One such individual is both a&nbsp;<a href=\"https:\/\/archive.ph\/wbKMU\">consultant<\/a>&nbsp;for the Gaithersburg, Maryland-based Wenzhou Chamber of Commerce Greater Washington and also the&nbsp;<a href=\"https:\/\/archive.ph\/IpKt4\">co-chairman<\/a>&nbsp;of the Azusa, California-based U.S.-Zhejiang General Chamber of Commerce.<\/p>\n\n\n\n<p>This individual not only serves as a&nbsp;<a href=\"https:\/\/archive.ph\/dN3Ez\">mediator<\/a>&nbsp;for the Wenzhou People\u2019s Court, but also as a Zhejiang MPS&nbsp;<a href=\"https:\/\/archive.ph\/1Kcc0\">supervisor<\/a>,&nbsp;stemming from his work&nbsp;<a href=\"https:\/\/web.archive.org\/web\/20180908162248\/http:\/\/www.senken-international.com\/welcome\/CEO.html\">founding<\/a>&nbsp;an MPS and Chinese military&nbsp;<a href=\"https:\/\/web.archive.org\/web\/20180608162749\/http:\/\/www.senken.com.cn\/news_detail\/110.html\">contractor<\/a>&nbsp;called Senken.<\/p>\n\n\n\n<p>He has also frequently met with MPS officials to discuss overseas Chinese police work including during an April 2024&nbsp;<a href=\"https:\/\/archive.ph\/HDTFE\">meeting<\/a>, which the&nbsp;<a href=\"https:\/\/archive.ph\/QxU6r\">chairman<\/a>&nbsp;of the Rosemead, California-based Sino-American Public Diplomacy Association also attended.<\/p>\n\n\n\n<p>The honorary chairman of the New York City-based American Fujian Association of Commerce and Industry is also connected to the MPS.<\/p>\n\n\n\n<p>A Chinese government document&nbsp;<a href=\"https:\/\/archive.ph\/JmymR\">reveals<\/a>&nbsp;he previously served as an officer in a CCP paramilitary organization called the People\u2019s Armed Police (PAP).<\/p>\n\n\n\n<p>After rising through the ranks, \u201cthe military repeatedly dispatched [him] to the U.S. to conduct protection work for overseas Chinese community organizations returning to China for inspection,\u201d the document states.<\/p>\n\n\n\n<p>He eventually retired from the military and joined the MPS just before moving to the U.S., according to the document.<\/p>\n\n\n\n<p>\u201cChina has built a vast UFWD network in the U.S. that the Chinese government and Party agencies use for command and control purposes,\u201d Scott McGregor, a former Royal Canadian Mounted Police intelligence official, told the DCNF. \u201cThese organizations are the main tool in China\u2019s ever expanding foreign infiltration strategy that now includes the installation of China\u2019s court and policing overseas.\u201d<\/p>\n\n\n\n<p>\u201cIt is obvious that the next step in the evolution of China expanding its control over overseas Chinese is now the creation of a dual judicial system that China operates inside the U.S.,\u201d McGregor warned.<\/p>\n\n\n\n<p>The U.S.-Zhejiang General Chamber of Commerce did not respond to multiple requests for comment and the Wenzhou Chamber of Commerce Greater Washington, Sino-American Public Diplomacy Association and American Fujian Association of Commerce and Industry could not be reached.<\/p>\n\n\n\n<p><img decoding=\"async\" also met with MPS officials to share information and discuss strengthening cooperation between Chinese police and overseas Chinese. Many of these meetings are colorfully described as \u201ctea parties.\u201d<\/p>\n\n\n\n<p>The secretary general of the Elmhurst, New York-based American Fuqing Association has attended three tea parties in the Honglu District of Fuqing, Fujian with officials from MPS and the All-China Federation of Returned Overseas Chinese (ACFROC), a UFWD&nbsp;<a href=\"https:\/\/cdn01.dailycaller.com\/wp-content\/uploads\/2024\/09\/LINDA-SUN-INDICTMENT.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">arm<\/a>.<\/p>\n\n\n\n<p>An ACFROC social media post&nbsp;<a href=\"https:\/\/archive.ph\/qI8yg\">reveals<\/a>&nbsp;he attended one February 2022 tea party where officials introduced their police station linked to Fuzhou\u2019s \u201cOverseas 110\u201d network, which by June 2022 had established 38 overseas police stations, Chinese state media&nbsp;<a href=\"https:\/\/web.archive.org\/web\/20220621005955\/https:\/\/www.chinanews.com.cn\/hr\/2022\/06-21\/9784721.shtml\">reported<\/a>.<\/p>\n\n\n\n<p>Attendees of the tea party also discussed measures to \u201cpersuade\u201d certain persons in Myanmar to return to China.<\/p>\n\n\n\n<p>\u201cPersuasion to return\u201d is the \u201cuse of non-traditional, often illegal, means of forcing someone to return to China against their will,\u201d&nbsp;<a href=\"https:\/\/safeguarddefenders.com\/sites\/default\/files\/pdf\/INvoluntary%20Returns.pdf\">according<\/a>&nbsp;to human rights group Safeguard Defenders.<\/p>\n\n\n\n<p>The secretary general attended a second MPS tea party in January 2023 along with the honorary chairman of the Honolulu-based U.S. Hawaii Fujian United Association, another ACFROC social media post&nbsp;<a href=\"https:\/\/archive.ph\/t8BQn\">states<\/a>.<\/p>\n\n\n\n<p>\u201cDuring last year\u2019s tea party, the issue of fraud in northern Myanmar keeping compatriots from returning to conduct business normally in Myanmar was raised,\u201d the secretary general said at the event. \u201cThe issue was resolved in a timely manner with the efforts of ACFROC and various cooperating departments.\u201d<\/p>\n\n\n\n<p>A third ACFROC social media post&nbsp;<a href=\"https:\/\/archive.ph\/JZXFQ\">shows<\/a>&nbsp;both nonprofit leaders also attended the most recent February 2024 MPS tea party, during which one ACFROC official said attendees would serve to connect MPS with overseas Chinese and globalize China\u2019s national policies.<\/p>\n\n\n\n<p>Leaders from the Highland Falls, New York-based Fuzhou Association of USA, New York City\u2019s United Chinese Associations of Eastern United States, California\u2019s U.S. Wenzhou Association and the aforementioned American Fujian Association of Commerce and Industry have also met with MPS officials in recent years, Chinese government&nbsp;<a href=\"https:\/\/archive.ph\/fwD0H\">announcements<\/a>, social media&nbsp;<a href=\"https:\/\/archive.ph\/2tVu0\">posts<\/a>&nbsp;and state media&nbsp;<a href=\"https:\/\/archive.ph\/tSjuk\">reports<\/a>&nbsp;likewise&nbsp;<a href=\"https:\/\/archive.ph\/7lzln\">reveal<\/a>.<\/p>\n\n\n\n<p>The Fuzhou Association of USA, United Chinese Associations of Eastern United States and U.S. Hawaii Fujian United Association could not be reached for comment and the American Fuqing Association and U.S. Wenzhou Association did not respond to multiple requests for comment.<\/p>\n\n\n\n<p>\u201cThe Communist Party believes it has the Mandate of Heaven to rule \u2018tianxia,\u2019 or \u2018All Under Heaven.\u2019 Worse, the CCP believes it has the obligation \u2014 not just the right \u2014 to do so,\u201d author and China expert Gordon Chang told the DCNF. \u201cAmong other things, this means that every point of contact the regime maintains with our country constitutes a threat to our sovereignty and hence our national security. There are no innocent contacts.
